California just rewrote the rules for what you’re allowed to bolt onto your car, and almost nobody noticed until the number “70 percent” started circulating.
On August 17, the California Energy Commission voted 5-0 to adopt regulations creating the country’s first minimum efficiency standard for replacement tires. The authority isn’t new. AB 844 handed the CEC this assignment back in 2003, and the agency spent 23 years getting around to it. What’s new is the enforceable number.
What the rule actually measures
Rolling resistance coefficient is a ratio: newtons of drag per kilonewton of load on the tire. Dimensionless, expressed as N/kN. Almost all of it comes from hysteresis, the energy a rubber compound eats every time the tread and belt package squashes into the contact patch and springs back. That energy leaves as heat and never comes back.
The adopted text sets a general passenger-car ceiling of 9.0 N/kN for tires manufactured on or after January 1, 2029, dropping to 7.1 N/kN for anything built on or after January 1, 2033. Testing follows ISO 28580:2018, correlated to the European lab network, so a manufacturer already certifying tires for the EU label doesn’t need a separate program.

Put real numbers on it. A 3,300-pound sedan puts about 14.7 kN on the ground. At 9.0 N/kN that’s roughly 132 newtons of drag. At 7.1 it’s about 104. The 28-newton difference is around 1.1 horsepower at 65 mph. That sounds trivial until you multiply it by every mile every Californian drives, which is exactly the CEC’s argument.
The rule is tiered, and the tiers matter to anyone who buys interesting tires. Ultra-high-performance, ultra-long-life, and run-flat tires get 9.8 in Phase 1 and 8.5 in Phase 2. Long-life gets 9.4 then 7.8. Low-load-index tires get 9.5 then 7.6. Light truck and commercial tires get 9.0 then 7.8. Note how UHP is defined: speed symbol W, Y, or (Y), capability above 168 mph, and a relative wet grip index of at least 1.45. A tire has to earn the looser efficiency allowance by actually stopping, not by wearing a sporty tread pattern.
The safety floor nobody asked for and everyone should want
Section 3308 bars the sale of any covered replacement tire built after January 1, 2029 with a relative wet grip index below 1.0, measured against a standard reference tire. There is no federal equivalent. FMVSS 139 doesn’t set a wet braking minimum, and UTQG traction grades are a coarse peak-friction measurement that most tires clear at grade A.
This exists because efficiency and wet grip pull on the same lever. Both are hysteresis phenomena, just at different excitation frequencies. Kill the compound’s energy loss to chase rolling resistance and you can kill its ability to grip a wet road. Silica-silane compounding decoupled those curves considerably in the 1990s, which is why the CEC’s staff analysis concluded there’s no inherent tradeoff. USTMA disagrees on the margins, telling the commission in its August filing that there are “real and quantifiable tradeoffs among rolling resistance, tread life, and wet traction.”
Where the “hundreds of dollars” figure comes from
The CEC’s own math says compliance adds $1.50 per tire in Phase 1 and $6.50 in Phase 2, or $6 and $26 per set. Against $179 in fuel savings over a set’s life at $4.60 gasoline, the agency claims a payback of about seven months. Its rebuttal page states flatly that the standards will “save consumers hundreds of dollars.”
The counterargument, filed in the docket by Sacramento lobbyist Bret Gladfelty on behalf of tire industry clients, doesn’t dispute the engineering cost. It disputes the substitution. Applying the 7.1 limit to the 114 passenger-car SKUs in the CEC’s own Smithers test population would strike 102 of them. The average price of what survives climbs from $149.92 per tire to $241.22. That’s $365.20 per set, which the letter argues is not “a marginal $6.50-per-tire issue.”
Both things can be true. Redesigning a compound is cheap per unit. Being pushed out of the $89 tire aisle and into the $190 aisle is not. Discount Tire, which runs 151 California stores, told commissioners that applying Phase 2 to its current California catalog would mean “roughly 70 percent of currently available options would be removed from the market.” That’s the source of the number now bouncing around the internet, and it came from a retailer that supports the program.
The exemptions worth memorizing
Excluded from the definition of replacement tire entirely: retreads, used tires, deep tread tires at 18/32 or greater, winter-type snow tires, rims 13 inches and smaller, motorcycle tires, ATV tires, load index 122 and up, tires not rated above 50 mph, large off-road tires 34.5 inches or larger with a Q speed rating, and competition tires.
The competition carve-out is narrow and cumulative. A tire must have 8/32 or less tread depth, a W/Y/(Y) speed rating, UTQG treadwear of 200 or less, and no all-season classification. SEMA and its Off-Road Business Association pointed out that rally, drag, and vintage racing tires routinely fail one or more of those and asked for the criteria to be alternative rather than cumulative. They lost that one.
The biggest loophole is the new all-season winter performance category: a UTQG-graded tire that hits a 112 snow traction index and wears the three-peak mountain snowflake. Those tires are exempt from both the efficiency standard and the wet grip floor. A 3PMSF-rated all-terrain walks out of the rule entirely.
Also exempt: limited production tires under 15,000 units a year nationally, which covers a lot of the odd sizes classic owners need.
What this means if you buy tires
The trigger is date of manufacture, not date of sale. A tire built December 2028 is legal to sell in California forever. Read the DOT date code, because inventory will be legal long after the standard bites.

Buying out of state won’t work either. The regulation defines a California sale as any sale for end use in the state regardless of seller location, explicitly including internet, telephone, and mail order.
There’s no point-of-sale placard requirement. The zero-to-four “leaf” efficiency rating lives in a state database, so you’ll be looking it up yourself.
And the boring maintenance point that outruns all of this: inflation pressure moves rolling resistance more than tire selection does. Running a set six psi low gives back every bit of efficiency the regulation just bought, plus shoulder wear and a hotter carcass. Check pressures monthly.
One caveat on timing. The commission adopted the text, but the Office of Administrative Law still has to review and file it with the Secretary of State before it’s law. The CEC’s own cover note says only the OAL-finalized version represents the official requirements.
